OBJECTIVES: The Mortgage Rights (Scotland) Act 2001 has been in force for over two years. It is successfully preventing many families in Scotland from losing their homes. This half day seminar will examine difficult and topical issues in practice both from the debtor and creditor viewpoint. Some of the issues to be discussed include:
· reasonable repayment of arrears
· full hearings: evidential issues
· indemnity insurance problems and third party procedure
· refinancing and endowments
· legal costs indemnity clauses in mortgages
· unfair charges and penalties and the Unfair Terms in Consumer Contract Regulations 1999
· help with housing costs from the Department of Works and Pensions
· topical legal tactics
· late application and reponing
PARTICIPANTS: This event will be of benefit not only to solicitors involved in mortgage repossession proceedings but anyone who gives advice to prevent homelessness, including advice workers, housing officers and social work professionals.
SPEAKERS: Mike Dailly, Principal Solicitor, Govan Law Centre undertakes a large volume of Section 2 Applications on behalf of debtors under the MRA, including evidential hearings. He is editor of Greens Housing Law Reports and author of a forthcoming book which deals with this subject, "Housing Law in Practice" (forthcoming, W. Green) and Mark Higgins, Partner, Golds, Solicitors undertakes a large volume of enforcement litigation on behalf of lenders. He is the author of the leading text book on the MRA, "Scottish Repossessions", (W. Green).
