Mortgage Rights (Scotland) Act 2001 PURPOSE The Mortgage Rights (Scotland) Act 2001 was passed by the Scottish Parliament in June 2001. For the first time, occupiers of homeowner property will have a legal remedy where they face repossession. The experience in England, which has had similar legislation for many years, reveals that 45% of debtors in mortgage default can get back on their feet and stay in their homes. In Scotland, that would mean 1,350 fewer people having their homes possessed by lenders, 540 fewer applications to local authorities under the homelessness legislation and 405 fewer applications being classed as being in priority need. The remedy in Scotland will only work if there is take-up - and take-up will depend upon the ability of the legal profession and advice sector to utilize new remedies.
